Surgere Privacy Notice for California Residents
This Privacy Notice for California Residents (“California Privacy Notice”) supplements (except as noted below in the rights section) the information contained in Surgere’s Privacy Statement (the “Privacy Statement”). This California Privacy Notice applies solely to individuals, who are not working for us or applying for a job with us and who reside in the State of California (“California Consumers” or “you”). This California Privacy Notice uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018, California Privacy Notice as amended by the California Privacy Rights Act of 2020 and any other amendment, and its implementing regulations (collectively, the “California Privacy Laws”). Where this California Addendum refers to the Privacy Statement, the term Personal Data in the Privacy Statement is to be read as Personal Information with regard to this California Addendum.
TYPES OF PERSONAL INFORMATION WE COLLECT
Personal Information under California Privacy Laws is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device household. Personal Information does not include deidentified/aggregated details or other details outside the California Privacy Laws’ scope, including protected health information and data covered by sector-specific laws (such as the Fair Credit Reporting Act and Gramm-Leach-Bliley Act).
Surgere may have collected the following categories of Personal Information from California Consumers within the last twelve months:
- Identifiers: A name, contact information, IP address.
- Personal information categories listed in the California Customer Records statute (Cal. Civ. Code ¬ß 1798.80(e)): A name, signature, government-issued ID number (such as a passport, Social Security Number or driver’s license number), contact information, current or past work history and education. Some Personal Information included in this category may overlap with other categories.
- Commercial information: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Internet or other similar network activity: Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
- Protected classification characteristics under California or federal law: Age (40 years or older), national origin, citizenship, or marital status.
- Sensory data: Visual information, such as video recordings.
Surgere does not collect sensitive personal information, as that term is defined in the California Privacy Laws. You can find more details on the specific Personal Information we collect in our Privacy Statement.
Surgere obtains the categories of Personal Information listed above from the categories of sources listed in our Privacy Statement.
HOW WE USE YOUR PERSONAL INFORMATION
We use the Personal Information we collect for the business or commercial purposes described in our Privacy Statement. Surgere will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
HOW WE SHARE YOUR PERSONAL INFORMATION
Disclosures of Personal Information for a Business Purpose
Surgere may disclose your Personal Information to a third party for a business purpose.
In the preceding twelve months, Surgere may have disclosed the following categories of Personal Information for a business purpose:
- Identifiers
- California Customer Records Personal Information categories
- Protected classification characteristics under California or federal law
- Commercial information
- Internet or other similar network activity
We disclosed that data for a business purpose to the following categories of third parties:
- Resellers, Contractors, Installers
We may also provide your information to others, who are not third parties, as described in our Privacy Statement. [Although that statement refers to “third parties,” they are not third parties within the meaning of the California Privacy Laws.]
Sales and Sharing of Personal Information
We do not sell or share, as the California Privacy Laws define those terms, your Personal Information. Under the California Privacy Laws, “share” basically means making data available to third parties so they can provide you targeted advertising based on your activity with us and others.
Given that we have not sold or shared data, we do not have actual knowledge of selling or sharing data on individuals under 16.
ACCESSING AND MAKING CHOICES ABOUT YOUR PERSONAL INFORMATION
Access to Specific Information and Data Portability Rights
You have the right to request that Surgere disclose certain information to you about our collection and use of your Personal Information. You can ask us to provide you:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- Our business or commercial purpose for collecting your Personal Information.
- The categories of your Personal Information we disclosed to third parties for a business purpose.
- The categories of third parties to whom we disclosed your Personal Information for a business purpose.
- The specific pieces of Personal Information we collected about you (also called a data portability request).
Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will provide you the requested information, unless an exception applies.
Correction Request Rights
You have the right to request that Surgere correct any of your Personal Information that we collected from you. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will assess whether our records inaccurate. If we agree that our information is not accurate, we will correct your Personal Information in our records, unless an exception applies.
Deletion Request Rights
You have the right to request that Surgere delete any of your Personal Information that we collected from you. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will delete your Personal Information from our records, unless an exception applies.
Exercising Your Rights
We will not discriminate against you for exercising any of your California Privacy Laws’ rights.
To exercise the rights described above, please submit a verifiable consumer request to us by contacting us using the contact information listed below.
When you submit your request, you must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. If you have an agent submit a request for you, we will require they provide us with written permission demonstrating that you authorized the agent to act on your behalf.
We cannot honor your request if we cannot verify your identity or authority to make the request. We will attempt to verify your identify by comparing the information you provide with the details we have on file. If we are unable to do so, we may ask you for more information-such as your name, email address, or employer (if we collected your Personal Information in the context of your professional activities), or similar information.
Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.
We will only use Personal Information you provide in connection with your request to verify your identity or authority to make the request.
Changes to Our Privacy Notice
Surgere reserves the right to amend this California Privacy Notice. The revised version of this California Addendum will be posted on our website. When we make material changes to this notice, we will notify you of such updates by email and/or posting a notice on our website.
